Este ensaio teórico tem como objetivo central analisar e debater o pensamento, principalmente na área educacional, do pedagogista e filósofo austríaco Otto Willmann, considerado o fundador da pedagogia social moderna. Trata-se de um estudo de caráter bibliográfico, que faz uso, em primeiro plano, da única obra do autor traduzida para o português e de outras escritas por comentaristas contemporâneos, bem como textos recentes de reflexão, nos quais são analisados o contexto histórico, as influências que ele sofreu, como as teorias de (...) Johann Friedrich Herbart, a sua biografia, as suas obras e não somente a sua contribuição à história do pensamento pedagógico, mas também possíveis contribuições à situação educacional dos dias de hoje. Em um período de grandes mudanças de pensamento no Ocidente, principalmente no mundo germânico do século XIX, um dos aspectos discutidos é como Otto Willmann conseguiu conciliar o aspecto individual com o social na pedagogia, evitando alguns dos extremismos característicos de sua época, como o psicologismo e o determinismo sociais, sendo um pioneiro da pedagogia social. Além disso, busca demonstrar como ele se constituiu um intelectual público, no sentido cunhado por Henry Giroux, contribuindo para transformações em sua realidade, no caso, o Império Austríaco. Entende-se, então, que Willmann se tornou um pensador que buscou a conciliação entre os aspectos individual e social na pedagogia e na didática, justificando, a partir disso, a cientificidade de ambas as áreas, demonstrando a importância do estudo da sociologia e da história da educação como ciências auxiliares da educação. Deep brain stimulation is part of state-of-the-art treatment for medically refractory Parkinson’s disease, essential tremor or primary dystonia. However, there are multiple movement disorders that present after a static brain lesion and that are frequently refractory to medical treatment. Using Holmes tremor as an example, we discuss the effectiveness of currently available treatments and, performing simulations using a Markov Chain approach, propose that DBS with iterative parameter optimization is expected to be more effective than an approach based on sequential trials (...) of pharmacological agents. Since, in DBS studies for HT, the thalamus is a frequently chosen target, using data from previous studies of lesion connectivity mapping in HT, we compared the connectivity of thalamic and non-thalamic targets with a proxy of the HT network, and found a significantly higher connectivity of thalamic DBS targets in HT. The understanding of brain networks provided by analysis of functional connectivity may thus provide an informed framework for proper surgical targeting of individual patients. Based on these findings, we argue that there is an ethical imperative to at least consider surgical options in patients with uncommon movement disorders, while simultaneously providing consistent information regarding the expected effectiveness and risks, even in a scenario of surgical-risk aversion. An approach based on n-of-1 DBS trials may ultimately significantly improve outcomes while informing on optimal therapeutic targets and parameter settings for HT and other disabling and rare movement disorders. Refletimos sobre a violência que frequenta as instituições escolares partindo do pressuposto de que ao se apresentar na escola de maneira molecular, a violência evidencia o reflexo do que já se encontra posto na sociedade. No que se refere à escola, é necessário pensar o fenômeno violento como uma realidade que cada dia mais toma o cenário escolar e demanda de educadores, alunos e famílias respostas novas e inventivas aos problemas advindos da complexa relação a que a violência os expõem. Tendo vista uma compreensão mais detalhada do fenômeno, realizamos uma análise da violência que adentra os muros da escola, servindo-nos de uma classificação muito utilizada entre os teóricos pesquisadores do assunto: a violência da, na e contra a escola. Estudando separadamente cada uma destas formas de violência, acreditamos poder abarcar, ainda que não tão profundamente quanto o tema exige, as formas com que a violência tem sido vivenciada na escola por seus sujeitos discentes e docentes e por toda a comunidade em que ela se insere. Refletir sobre o fenômeno violento e suas implicações, abrindo espaços de fala dentro das instituições escolares para que ele seja discutido e problematizado, pensamos ser um dos possíveis caminhos para superação da violência. Este artigo objetiva expor e analisar os diferentes sentidos do conceito de verdade delineados por Edmund Husserl na 6ª _Investigação Lógica_. Inicialmente, aborda-se a concepção tradicional de verdade enquanto correspondência em seus aspectos mais fundamentais. A seguir, examina-se como essa ideia de adequação, reinterpretada fenomenologicamente a partir da estrutura intencional do preenchimento, orienta a reflexão husserliana ao conceito de evidência e, por sua vez, como essa análise conduz à tematização do conceito de verdade, uma vez que Husserl define a verdade (...) como o correlato objetivo da evidência. Com isso, chega-se ao núcleo da investigação: procede-se com a caracterização e discussão dos quatro sentidos de verdade elencados por Husserl no parágrafo 39 da 6ª _Investigação Lógica._ Por fim, são apontados alguns aspectos gerais que articulam esses quatro sentidos, com ênfase especial na primazia do sentido de verdade enquanto “ser verdadeiro” em relação aos demais sentidos fenomenológicos apresentados do conceito. The contemporary debate on the ethics of cognitive enhancement has mainly focused on the question whether, and to which extent, individuals should be granted the right to make use of new technologies in order to enhance their own cognitive powers. The question on the existence of a duty to implement the cognitive enhancement of the individuals has received less attention. In this paper, I argue that the state has a prima facie duty to pursue the cognitive enhancement of its citizens. (...) The argument involves an analysis of the so-called effect Flynn and of the public policies for the education of gifted children. The duty the state has to further the cognitive enhancement of its citizens is qualified by our knowledge of the efficacy and the safety of the procedures used for cognitive enhancement. (shrink)

La mission géoarchéologique dans le marais de Malia (fig. 14) a eu lieu du 16 au 23 octobre 2015. Elle s’inscrivait dans la continuité des recherches sur l’évolution paléogéographique de la plaine et du littoral de Malia effectuées depuis 1993. La première campagne de carottages qui avait alors été réalisée avait mis en évidence le potentiel des archives sédimentaires du remplissage holocène du marais, tout en ne fournissant que des résultats partiels ou lacunaires. En el presente trabajo se propone un estudio comparativo de las producciones de algunos referentes de la Investigación Participativa. Se revisan algunos de los textos de Orlando Fals Borda, Paulo Freire, João Bosco Guedes Pinto, Michel Thiollent, María Teresa Sirvent y Joel Martí. Este trabajo se inscribe en el proceso reciente de transformación universitaria en Uruguay, en particular, en una de sus iniciativas: la de la integración curricular de la extensión a través de lo que se ha denominado “prácticas universitarias (...) integrales”. En este marco, la reflexión teórico-metodológica sobre la extensión crítica y las prácticas de investigación-acción conectadas con ella resultan fundamentales para dotar las iniciativas en curso de mayor pertinencia académica y potencial transformador. Multialgebras have been much studied in mathematics and in computer science. In 2016 Carnielli and Coniglio introduced a class of multialgebras called swap structures, as a semantic framework for dealing with several Logics of Formal Inconsistency that cannot be semantically characterized by a single finite matrix. In particular, these LFIs are not algebraizable by the standard tools of abstract algebraic logic. In this paper, the first steps towards a theory of non-deterministic algebraization of logics by swap structures are given. Specifically, (...) a formal study of swap structures for LFIs is developed, by adapting concepts of universal algebra to multialgebras in a suitable way. A decomposition theorem similar to Birkhoff’s representation theorem is obtained for each class of swap structures. Moreover, when applied to the 3-valued algebraizable logics J3 and Ciore, their classes of algebraic models are retrieved, and the swap structures semantics become twist structures semantics. This fact, together with the existence of a functor from the category of Boolean algebras to the category of swap structures for each LFI, suggests that swap structures can be seen as non-deterministic twist structures. This opens new avenues for dealing with non-algebraizable logics by the more general methodology of multialgebraic semantics. (shrink)

In 2016, Béziau introduces a restricted notion of paraconsistency, the so-called genuine paraconsistency. A logic is genuine paraconsistent if it rejects the laws $\varphi,\neg \varphi \vdash \psi$ and $\vdash \neg (\varphi \wedge \neg \varphi)$. In that paper, the author analyzes, among the three-valued logics, which of them satisfy this property. If we consider multiple-conclusion consequence relations, the dual properties of those above-mentioned are $\vdash \varphi, \neg \varphi$ and $\neg (\varphi \vee \neg \varphi) \vdash$. We call genuine paracomplete logics those rejecting (...) the mentioned properties. We present here an analysis of the three-valued genuine paracomplete logics. A very natural twist structures semantics for these logics is also found in a systematic way. This semantics produces automatically a simple and elegant Hilbert-style characterization for all these logics. Finally, we introduce the logic LGP which is genuine paracomplete is not genuine paraconsistent, not even paraconsistent and cannot be characterized by a single finite logical matrix. (shrink)

In 1988, J. Ivlev proposed some (non-normal) modal systems which are semantically characterized by four-valued non-deterministic matrices in the sense of A. Avron and I. Lev. Swap structures are multialgebras (a.k.a. hyperalgebras) of a special kind, which were introduced in 2016 by W. Carnielli and M. Coniglio in order to give a non-deterministic semantical account for several paraconsistent logics known as logics of formal inconsistency, which are not algebraizable by means of the standard techniques. Each swap structure induces naturally a (...) non-deterministic matrix. The aim of this paper is to obtain a swap structures semantics for some Ivlev-like modal systems proposed in 2015 by M. Coniglio, L. Fariñas del Cerro and N. Peron. Completeness results will be stated by means of the notion of Lindenbaum–Tarski swap structures, which constitute a natural generalization to multialgebras of the concept of Lindenbaum–Tarski algebras. Walter Bock was committed to developing a framework for evolutionary biology. Bock repeatedly discussed how evolutionary explanations should be considered within the realm of Hempel’s deductive-nomological model of scientific explanations. Explanation in evolution would then consist of functional and evolutionary explanations, and within the latter, an explanation can be of nomological-deductive and historical narrative explanations. Thus, a complete evolutionary explanation should include, first, a deductive functional analysis, and then proceed through nomological and historical evolutionary explanations. However, I will argue that (...) his views on the deductive proprieties of functional analysis and the deductive-nomological parts of evolution fail because of the nature of evolution, which contains a historical element that the logic of deduction and Hempel’s converting law model do not compass. Conversely, Bock’s historical approach gives a critical consideration of the historical narrative element of evolutionary explanation, which is fundamental to the methodology of the historical nature of evolutionary theory. Herein, I will expand and discuss a modern view of evolutionary explanations of traits that includes the currentacknowledgement of the differences between experimental and the historical sciences, including the token and type event dichotomy, that mutually illuminate each other in order to give us a well confirmed and coherent hypothesis for evolutionary explanations. Within this framework, I will argue that the duality of evolutionary explanations is related to two components of character evolution: origin, with its evolutionary pathways along with the history, and maintenance, the function (mainly a current function) for the character being selected. Dugundji proved in 1940 that most parts of standard modal systems cannot be characterized by a single finite deterministic matrix. In the eighties, Ivlev proposed a semantics of four-valued non-deterministic matrices, in order to characterize a hierarchy of weak modal logics without the necessitation rule. In a previous paper, we extended some systems of Ivlev’s hierarchy, also proposing weaker six-valued systems in which the axiom was replaced by the deontic axiom. In this paper, we propose even weaker systems, by eliminating (...) both axioms, which are characterized by eight-valued non-deterministic matrices. In addition, we prove completeness for those new systems. It is natural to ask if a characterization by finite ordinary logical matrices would be possible for all those Ivlev-like systems. Although the controversy between Malthus and Ricardo has long been considered to be an important source for the history of economic thought, it has hardly been the object of a careful study qua controversy, i.e. as a polemical dialogical exchange. We have undertaken to fill this gap, within the framework of a more ambitious project that places controversies at the center of an account of the history of ideas, in science and elsewhere. It is our contention that the dialogical co-text (...) is essential for reconstructing the meaning and the evolution of science. In the present paper we try to substantiate this contention by means of a pragma-rhetorical study of this particular controversy. First, we reconstruct, through an analysis of a chunk of the correspondence, a micro-level of specific moves and countermoves which constitute a sequential structure within which also meta-scientific and meta-controversial considerations play a role. We then move to a macro-level of analysis, looking for recurrent patterns of argumentation. Finally, we draw epistemological conclusions on the nature of rationality and progress as manifested in actual scientific controversies. (shrink)

Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. A recent paper by Jakl, Jung and Pultr succeeded for the first time in establishing a very natural link between bilattice logic and the duality theory of d-frames and bitopological spaces. In this paper we further exploit, extend and investigate this link from an algebraic and a logical point of view. In particular, we introduce classes of algebras that extend bilattices, d-frames and N4-lattices to a setting in which the negation is not necessarily involutive, and we study corresponding logics. This volume, edited by Antony McKenna and Gianni Paganini, is a good sample of the volume, quality, scope, and polemical nature of current Bayle scholarship. The book contains twenty-five articles by the main Bayle scholars from France, Italy, England, the Netherlands, Canada, and the United States. It also contains an introduction by the editors, who give an overview of current scholarship, summarizing its main trends and achievements, and a useful name index. The articles are organized in five sections, each dealing with some aspect of Bayle's life and thought.The first set of articles, gathered under the heading, "Interlocutors, Friends and Enemies," deals with Bayle's personal relations as a Huguenot exiled in the Netherlands. Luisa Simonutti deals with Bayle's relations to one of the radical Reformed groups in Holland, the Quakers. Although Bayle disagreed with their religious views, he respected and maintained [End Page 476] healthy intellectual exchanges with them. Hans Bots examines Bayle's view of the "republic of letters," of which he was a major architect—a republic whose right to citizenship required the suspension of religious, political, and national partisanship and engagement in free intellectual debate. H. H. M. van Lieshout contests the entrenched view that Bayle lived as a recluse scholar in Rotterdam. Both she and Bots show how Bayle's main work, the Dictionary, exhibits his life committed to the "republic of letters." He replies to Solère's objections to his interpretation in an appendix to his article. In this paper, we argue that the Epicurean genealogy of justice and laws presuppose an analysis of the just as a modality of the useful, an approach that denies the conventional character of justice. This genealogical pattern differentiates the origin of justice from that of the law and refers to friendship as a relevant explanatory factor of the origin of justice. We maintain that the interpretations that underline the incoherence of this reference to friendship, in the framework of a hedonistic (...) theory, presuppose a non-Epicurean sharp distinction between altruism and selfishness. In this paper, we argue that the fact that there were prominent citizens of different Greek cities who adhered to Epicureanism, felt themselves Epicurean, and were recognized as such, shows that slogans such as “live unnoticed” and “do not participate in politics” (which suggest a complete apoliticism on Epicurus’ and the Epicureans’ part) misrepresent the true meaning of the Epicurean staying away from contingent politics. Our article shows the interaction between Epicurus and the Epicureans and the Greek cities through the (...) analysis of documents (some of them, well known -such as Epicurus’ Testament, which shows the connections of the philosopher with the political life of the city-, others less known of epigraphic character) related to different ancient cities. If what we argue is sound, the usual idea that Epicureanism recommends apoliticism must be discarded. (shrink)

In this note, an error in the axiomatization of Ivlev’s modal system Sa+ which we inadvertedly reproduced in our paper “Finite non-deterministic semantics for some modal systems”, is fixed. Additionally, some axioms proposed in were slightly modified. All the technical results in which depend on the previous axiomatization were also fixed. Finally, the discussion about decidability of the level valuation semantics initiated in is taken up. The error in Ivlev’s axiomatization was originally pointed out by H. Omori and D. Skurt (...) in the paper “More modal semantics without possible worlds”, where an alternative solution was proposed. (shrink)

This paper focuses on Gilberto Gomes’ work on free will. In a series of contributions that have had a significant impact on the respective literature, Gomes developed a conception about free will and argued that its existence is consistent with recent scientific findings, specially in neuroscience. In this paper, I object to a claim of Gomes about his conception of free will, namely the claim that it is a compatibilist conception. I seek to show that Gomes does not use the (...) term ‘compatibilism’ as it is usual in the contemporary literature on free will, i.e., as the thesis that free will can exist even if determinism is true. Moreover, the conception of free will Gomes proposes actually has an incompatibilist commitment. I argue that, more than a mere terminological point, acknowledging the incompatibilist aspect of Gomes’ view motivates important questions about the details of the view and helps to reveal a limitation of his defense of the existence of free will. [Este artigo tem como tema o trabalho de Gilberto Gomes sobre o livre-arbítrio. Em uma série de contribuições que tiveram um impacto significativo na respectiva literatura, Gomes elaborou uma concepção sobre o livre-arbítrio e argumentou que sua existência é consistente com descobertas científicas recentes, especialmente na neurociência. Neste artigo, questiono uma afirmação de Gomes sobre sua concepção sobre o livre-arbítrio, a saber, que se trata de uma concepção compatibilista. Busco mostrar que Gomes não usa o termo ‘compatibilismo’ como é habitual na literatura contemporânea sobre o livre-arbítrio, isto é, como a tese segundo a qual o livre-arbítrio pode existir ainda que o determinismo seja verdadeiro. Ademais, a concepção sobre o livre-arbítrio desenvolvida por Gomes tem, efetivamente, um compromisso incompatibilista. Argumento que, mais do que uma mera elucidação terminológica, reconhecer o elemento incompatibilista presente na proposta de Gomes suscita questões importantes sobre os detalhes da proposta e também ajuda a reconhecer uma limitação de sua defesa da existência do livre-arbítrio.]. Este artigo visa apresentar as relações entre as religiões e o Estado no Brasil evitando um enquadramento teleológico e normativo, onde um modelo universal sirva de paradigma. Para tal, busca construir um mosaico de configurações diferenciadas que expressam situações de laicidade desiguais, mas convivendo entre si no país. Visa então, apresentar a própria noção de laicidade, tal como foi apropriada no Brasil, enquanto um processo que envolve conflitos, negociações e acordos em marchas e contra-marchas. Isto se dá através da interação (...) de atores sociais, sejam eles quadros religiosos da Igreja Católica, evangélicos, pentecostais e das religiões afro-brasileiras, ou setores organizados da sociedade civil e agentes estatais do sistema político e jurídico. As controvérsias em que estes atores sociais religiosos e laicos estão envolvidos abrangem um conjunto de temas, que vão desde aqueles que prefiguram uma retração da religião como descriminalização do aborto, união civil de homossexuais, inclusão dos direitos sexuais e reprodutivos no rol dos Direitos Humanos, até os que implicam na sua promoção como, o ensino religioso na escola pública e a presença de símbolos religiosos em repartições e fóruns estatais. Por fim, como não existe nenhuma definição normativa pré-existente do que seja laicidade, o que o texto postula é que, pelo caráter polissêmico que adquiriu no Brasil, esta noção é sempre invocada pelos segmentos em disputa - laicos e religiosos - de acordo com suas concepções e interesses próprios. Corporations that provide services such as water, sewage disposal and electricity in poor countries or deprived areas face political, social and economic problems that make it difficult to simultaneously favor the interests of shareholders and other relevant stakeholders. In this paper a case study is presented in which a company, Aguas Argentinas, promoted innovative and participative multistakeholder involvement that produced benefits for all parties. Key factors in the model employed were the generation of credibility and trust, adaptive management to the (...) specific situation of deprived areas, stakeholder dialogue, and participation. It is argued that understanding corporate citizenship as reciprocity and common effort in solving interdependent problems were fundamental to the success of the company in this case. (shrink)

This article studies preservation of certain algebraic properties of propositional logics when combined by fibring. The logics analyzed here are classified in protoalgebraic, equivalential and algebraizable. By introducing new categories of algebrizable logics and of deductivizable quasi-varieties, it is stated an isomorphism between these categories. This constitutes an alternative to a similar result found in the literature.

Although the reception of John Dewey's _Art as Experience_ has not been totally ignored by secondary literature, the few works that have dealt with the subject have been restricted to the English-speaking context, and more specifically to the United States. This essay sought to consider the reception of Dewey's book on aesthetics in the context of Spanish-speaking countries, with special attention to Mexico, Spain, Colombia, and Argentina. The hypothesis put forward and supported here is that _Art as Experience_ had a (...) late reception due to political and cultural factors in these countries and that it is at present that we really find a deeper reception of this work, with an increasing number of publications about the subject. Summary Pluralism and monism are the two current views concerning scientific research and language understanding. Between them there is a third, intermediate, view. We take a procedural methodology of science as exemplified in the work of L. Tondl, and procedural linguistics , as exemplified in the work of B. Harrison, to be representative of this third possibility. Procedures are cognitive, linguistic, and physical processes which, through their hierarchical interconnections can generate fruitful mechanisms . These mechanisms are sensitive to context and (...) operate in heuristic and algorithmic ways. Their similar logical structure points towards a profound unified basis for scientific and linguistic activities, thus providing an interesting bridge between what is achieved by a little child talking to his parents, and a creative scientist struggling to interpret the results of his experiments. El viernes 01 de julio de 2022 se realizó, en el edificio Sergio Karakachoff de la UNLP, la presentación de los dos volúmenes de la "Antología comentada" de la obra de José Sazbón compilados por Alberto Pérez y Daniel Lvovich. A recent stream of epistemology gives special relevance to ignorance within the framework of an epistemological theory. Indeed, some want to give a significant role to ignorance in epistemological theorizing. In this paper, we argue that a particular sort of ignorance, which involves recognition of the fact that one is ignorant, is central to the acquisition of knowledge given the epistemic structure of society. It is clear, we hold, that Socrates realized the relevance of what we call ‘Socratic ignorance’ in (...) the acquisition of knowledge and was aware of the division of epistemic and cognitive labor that we find in our society. We shall explain the way we understand this Socratic ignorance, as opposed to what we will call ‘stubborn ignorance’ and the role this ignorance of Socratic overtones and related character traits can play in the acquisition of knowledge from others and with others. Through an interdisciplinary lens, the paper aims to provide a comprehensive understanding of this pervasive issue and contribute to the ongoing discourse on fostering transparent and accountable political systems._.

The purpose of this paper is to analyse a particularly influential case of memory continuity in Portugal, that of _Padrão dos Descobrimentos_. Spaces of collective memory (such as public monuments) raise questions about what we celebrate, remember or rescue from oblivion, providing an opportunity to rethink the trauma. As such, care for public spaces is associated with ethical and cultural values. One of the difficulties with certain monuments has to do with the fact that they recall actions that today we (...) see as traumatic acts. Thus, it is important to reflect on a critical use of memory. On August 8, 2021, _Padrão dos Descobrimentos_ was the subject of a graffiti. One of the sides of the monument could read: “Blindly sailing for money, humanity is drowning in a scarlet sea”. A great controversy immediately arose around the meaning of this gesture, as well as the role played by a monument that, after being temporarily built in 1940 for the Portuguese World Exhibition, was, in its current version, inaugurated in 1960, on the occasion of the fifth centenary of the death of Infante D. Henrique. This episode reignited a deeper cleavage around the uses of history and memory, the Portuguese colonial past, and the role of the _Padrão dos Descobrimentos_ as an instrument for the reproduction of nationalism. In this sense, and with the authors proposing a new theoretical frame of reference based on the thought of Arendt and Ricoeur, its critical reading becomes relevant. (shrink)

O uso de argumentos igualmente convincentes tanto em prol quanto contra a veracidade de uma proposição era conhecido na Renascença como in utramque partem. Céticos do início da Modernidade utilizaram argumentos in utramque partem visando demonstrar que não se pode fundamentar a moralidade em um terreno sólido, já que os argumentos apresentados em favor da ideia de Justiça poderiam ser neutralizados por argumentos igualmente convincentes contra a ideia de Justiça. Nesse artigo, eu argumento que Hugo Grotius tentou refutar esse tipo (...) de ceticismo moral em seus principais escritos filosóficos, De jure bellic ac pacis e De jure praedae commentarius. Contra os céticos, Grotius procura estabelecer que as razões apresentadas a favor e contra a ideia de Justiça não são incompatíveis entre si. (shrink)

Neural networks are widely used in systems of artificial intelligence, but due to their black box nature, they have so far evaded formal analysis to certify that they satisfy desirable properties, mainly when they perform critical tasks. In this work, we introduce methods for the formal analysis of reachability and robustness of neural networks that are modeled as rational McNaughton functions by, first, stating such properties in the language of Łukasiewicz infinitely-valued logic and, then, using the reasoning techniques of such (...) logical system. We also present a case study where we employ the proposed techniques in an actual neural network that we trained to predict whether it will rain tomorrow in Australia. (shrink)

Discuto aqui duas diferentes interpretações acerca do que seria uma teoria do direito natural. A primeira interpretação se caracteriza pela tese da “inseparabilidade” do direito e da moral, ao passo que a segunda se caracteriza pela tese segundo a qual existiriam “leis naturais”, i.e. leis cuja existência independeria da existência de instituições humanas. Tento mostrar que as duas teses são falsas. Procuro mostrar inicialmente que a confusão entre as duas teses se deve a uma má compreensão da distinção entre frases (...) do tipo “estar obrigado a”, e “ter a obrigação de”. Em seguida, mostro como a teoria moral contratualista nos permite resolver de modo satisfatório algumas questões que não são resolvidas adequadamente em nenhuma das duas versões do jusnaturalismo que apresento. [Note: articles 1-5 are in English; Intro, Discussion, and Conclusion are in Portuguese.] Responsibility practices that are part of our daily lives involve, among other things, standards about how one should praise, blame, or punish people for their actions, as well as particular acts that follow those standards to a greater or lesser extent. A classical question in philosophy asks whether human beings can actually be morally responsible for what they do. This dissertation argues that addressing this classical question is (...) insufficient if one wants the investigation of moral responsibility to serve the goal of improving ordinary responsibility practices. As an alternative, I offer directions for an interdisciplinary investigation that I take to be in a better position to promote that goal. My argument is developed in five articles and a discussion section. The first four articles describe limitations of skeptical views, which deny the existence of moral responsibility. The first article assesses a skeptical argument based on results from neuroscience that intends to show that there is no free will. I argue that a premise in the argument—which says that choices are determined by events in the brain—is not supported by the available results. The second article argues that, despite the fact that existent results do not show that choices are determined by brain events, further studies in neuroscience could in principle do that. The third article begins the discussion of limitations that concern the implementability of some of the changes in responsibility practices recommended in skeptical approaches. Specifically, I describe challenges that attempts to reduce the severity of legal punishment are likely to face due to psychological facts about belief in free will and desire to punish. The forth article presents results from an original experiment that sought to test a hypothesis about the workings of belief in free will and the desire to punish, namely the hypothesis that the desire to punish causally affects beliefs about free will. Results failed to support the hypothesis. Finally, the fifth article presents what I call the enhancement model, i.e., a proposal about how to structure an interdisciplinary investigation that can promote the enhancement of ordinary responsibility practices. The final discussion section shows how the enhancement model overcomes some of the limitations of recent discussions about the existence of moral responsibility, which includes not just the skeptical views considered in earlier articles, but also views that affirm the existence of moral responsibility and free will. The central claim of this dissertation, therefore, is that the investigation of moral responsibility can be rearranged so as to further the goal of improving ordinary responsibility practices.
